what do you all think about the latest controversies between builders over the 'alfresco quadrants'? lets just say that all these builders are competing against each other, and houses wil bear to be similar in at least one aspect - alfresco for one. and being that the provence and seattle designs are so similar in shape and size, they would share some similarities. the houses are different in different ways as well. have a look at the floorplans! what's the big deal? alfrescos are in almost every floorplan of any size builder, these days. in closing, carlisle homes are very unique in their own ways. they are not identical, or very similar to other houses of higher profile builders. what do you think about this? click on these links: http://www.austlii.edu.au/au/cases/cth/ ... 8/375.html http://www.realestatesource.com.au/Nati ... Homes.html Re: carlisle homes vs porter davis 2May 24, 2008 1:51 pm the most offender is M@tricon, a lot of their designs are very similar (or some of them even 100% copied), so PD won the court case and even the appeal. Now they proceed for other builder such as CH, DFH..etc i am not expert here, but i think the design in question is the Kitchen and Living areas open to the alfresco areas, which was unique design by PD at that time... and nowadays, you see a lot and a lot of houses with this design.. but the builders have to alter the design a little to avoid the copyright
in my view, i would like to see justice in this case, i am not saying who is copying from who, but i really like to see different or better design.. sometime i found that every displays are the same, very boring... those designers are just copying, i would like to see them to design something unique, a new design home always catch my eye, and you would wonder how they can think and do something like this... Barrett Property Group have a lot to answer for, **** in their own backyard. The project builder industry isn't as large as they think and suing other companies will eventually bite them in the arse! This court case does nothing for consumers but stifle creativity by granting copyright over a generic design concept.
