Just wondering what council requirements are for applying to build a shed over the easement? Is it a requirement to encase/enbumbus the pipes before we gain approval to build or is this not necessary if it's acknowledged that is at our cost if council ever needs to access easements in our lot. Bear with me as I am only a humble carpenter by trade so enlighten me. Is it a sewer easement, stormwater or both? Sewer only and the council doesn't have any say - it is Sydney Waters domain and they have strict guidelines as per their website. Sydney Water will let you build over their mains sewer but will make you concrete encase it and at $1100 per lineal meter makes it reasonably expensive. You have to submit plans for that pre-DA. If it is stormwater then that depends on your particular council and what their requirements are. A quick chat with a planning officer would be able to tell you. Many councils, and Sydney Water, will let you build a small (less than 10m2) lightweight (timber or colorbond on simple slab) shed over an easement with just a letter of indemnity. Thus you could just build it without an indemnity anyway. But of course if it impedes stormwater flows, or impedes maintenance in the easement area, you can be told to remove it also by the easement owner..
