We have not signed a building contract but the builder is still insisting that we have no choice but to build with them. There have been numerous developer and builder delays in even getting to a fixed price quotation stage. It has been 7 months since we signed the contract for the purchase of the land a contract and the contract specifies that a building contract had to be signed within 5 months of the land contract. If anyone would like to pass on their experience it would be very much appreciated. The contract has not been signed withing 5 months. Who owns the land the developer or builder? There should be described in the contract what would happen of you didn't sign within 5 months. Call the building commission/fair trading in your state without delay and it really is worth going to see your conveyancer/solicitor who exchanged your land contract and ask them to clarify what happens.
