ok so what happened was the first set of contracts we signed (havent signed final yet) with the base plan they used was the wrong one which had high ceilings but our one with the variations done didnt have the ceiling or dishwasher recess, the base plan we thought we were getting had a dishwasher recess and our builder keeps going on that it wasn't noted in our variations and didnt reply once i said it was in the base plan. so which one should i ask for, the high ceilings or dishwasher recess and can i make them give either to me???? help

Not really sure what you mean by 'First Contract' and 'Final Drawings'.
When you pay an initial deposit you are really only signing an 'Agreement' to pay the builder to do some investigations and initial design. At that stage what gets built is really still up for negotiation.
When you sign 'The Contract' Basically that is what you are agreeing should be built. Any changes to the structure will then be a variation.

... gets all their customers to sign 3 lots of contracts. the first 2 they tell you are preliminary and the 3 one is final. the first set you sign is one where you choose one of their designs to work with and that is the one i am talking about. the one i choose to work with has high ceilings on the plans yet when they applied my variations i didnt get high ceilings so can i ask them for them? Their also charging me council fees now of $1k which i didnt think they could do.

There is generally always a baseline cost to prepare and submit a DA to council.
Some builders will charge a premium for working with some councils. Some councils can be quite stringent or have extra processes which take more time / effort and hence the builder charges for this.
