4 years ago a builder replaced a joist in our house, on top of which they put a waterproof deck. They replaced a joist because the previous one had rotted due to a water leak. The waterproofing has now failed and I believe it is down to the new joist they put in. Attached is a photo of the joist. http://postimg.org/image/utslpzu6h/ My opinion is that they have notched it too severely to accommodate an existing power cable. Can you let me know your opinion and whether you believe I have a case for them to replace it and the waterproofing that has failed due to this joist not being sufficiently strong due to the notching? We are at our wits end trying to battle this. Whats our next step? They have now bricked the entire bottom floor over this issue, as they decided its ok. I know I said this before to other people but your inspector is best placed to assist you with your build issues and help you handle the builder (if your inspector is good enough). In saying that I am not on an ego trip but there is lot more to it than writing defect reports and copying an pasting BCA or Guide to Standards and Tolerances to dazzle the owner. When you select your inspector you have to be choosy and read between lines and be satisfied with qualifications, experience and track record. It seems your inspector's bus stop is way short of where you need to go and you will need another to take you the rest of the way. Your builder worked out he can roll you and he just did. Yes you can take it further and get builder to fix it but you will need someone more knowledgeable and aggressive to get the result, so be prepared to spend a bit. I can't help you unless you are in Victoria. The other issue is that this is just the early stage of your build, if you don't crunch him now what else will he get past you?
