Browse Forums General Discussion 1 Dec 19, 2013 3:50 pm [list=][/list]We were meant to be having our final inspection tomorrow,the builders are behind and won't be coming back to work and finishing off now until the 6th Jan next yr. We have now been told our final walkthrough will be around 12th Jan,this would be fine except only 2 wks ago the builder told us we were safe to not extend the lease on our property that we are renting so have to be moving out weekend 18th Jan. This does not leave enough time for final payment and bank inspection from the 12th to 18th. Our current rental has now been leased so we have to be out. I'm so annoyed with the builders for not letting us know sooner,I had too ring them to find this out,! shower screens apparently are still being made,well dfiudnt he know this before?? Painters and plumbers also behind! What are other people's experiences with this? Should the builder pay for us to stay somewhere or is it just bad luck? If the builder had of said extend your lease longer we could have now its too late! Re: Build not finished in time! 3Dec 21, 2013 1:25 pm You can get $250.00 payment for every week they are overdue of contracted completion date but there is extension to that date that can be added on. ie What is the ‘building period’? This is the construction time set by the builder to carry out the building works under the contract. Item 1 Schedule 1 of the HIA contract/s sets out estimate time for completing the building works together with an estimate for any delays during the course of construction. The estimates for time delays are included in the overall building period. The following are the types of delays included in the contract: Inclement weather Weekends Public holidays Rostered days off Builder's holiday close down period; and Other foreseeable delays The one that will effect you the most is the "Builder's holiday close down period". You will probability find this stated in an attachment to the contract as was in my case. Mine was 7 weeks over the contracted completion date (4 weeks xmas + 1 week Inclement weather) and I was paid $500.00 for 2 weeks overdue. We ended up with 1 week to spare to move in before settlement of our old home. Some extensions require writen notification as is for Inclement weather, not sure about the xmas break as its a fixed period in the building industry. Build completion date is supposedly 5/2/14 but we aren't even at lock up yet!! Same company is buidling a house 2 houses away which started MONTHS after us is nearly finished. Builder tried the old "yeah but you struck rock" routine to try to cover himself. $250 penalty per week is peanuts and they will just find some way of jacking up a bill somewhere to cover it. Our tradies are being shared between the jobs ( and likely whatever other jobs they have on the go!). Currently living with in-laws while build finishes rather than re-lease the rental we were in. and this build can not finish soon enough! Will not be recommending these guys to anyone.
