Our contract is the standard HIA one (as far as I can tell) And it states that they builder must obtain a building permit within 45 days of receiving developer design approval if required (which we do) then they need to being construction within 21 days of the permit being issued.
After being told that we were due to start construction last week, I've today found out that we don't even have approval from the design panel yet... they initially submitted plans on the 18th of sept which were turned down and we just needed to change roof tile and resubmit. We signed our roof tile variation on Sept 27th yet for some reason they didn't even submit the plans again until October 30th.
Is there anything we can do about the month long (and counting) delay they have caused us, or because its the no mans land before receiving panel approval do we just have to suck it up?
