He has asked for faults to be rectified, but the builder won't return calls or emails. On top of that, the builder now keeps emailing and asking for his money, even though the work is not up to scratch.
Question: who does my brother get in touch with to get some sort of action on the sloppy job? Is there a building board or something? Thanks. And no doubt if your brother doesn’t pay, and the builder refuses to come back and fix the problem, the builder may make the first move to get in contact with whoever it is to get it sorted. BUT….maybe not! I have a feeling the builder has done this before! The fact that he is emailing and not ringing, like he should, rings alarm bells for me. In Victoria it is BACV and in NSW it's the Department of Fair Trading. Your brother should get in contact with the relavent governement authority in your state and formally start a resolution process. Good luck. I agree with Rajasthan doors. 1. Dont pay the remainder. Write a letter clearly stating the problem ( facts) and send it by registered post. Give the builder 7 days to reply. 2. File a written complaint with the department of fair trading. You will need photos and maybe a building report stating the defects. ( They are however slow and take ages to do anything- as a statutory body they do not properly protect homeowers) 3. If you do not hear from Fair trading email copies of your letter to your local member for parliament seeking his assistance. 4. If you have to take your builder to the CTTT you will need a good building report and if the matter is under $10,000 you dont need a lawyer. But you have to know how to do your case.
