Legal mumbo jumbo! 3Oct 10, 2013 8:20 pm Quote: Wondering if anyone can give advice on what to check for in the building contract? So many pages of legal mumbo jumbo! I know people say get a lawyer to check but I'd have to let them know what I want to be in the contract first! So far I have this list: - the projected build time is stated, with weekly payment for running overtime (?what's standard for this - $400/week is our rent) build time is stated on contract and is normally extended by inclement weather days + xmas break (add 28 days for xmas). Ours was $250.00 per week and they where 2 weeks over contract (with all the added days) and paid us at settlement. Quote: - definition of rain days if they are claiming delays due to rain, and stating this only applies before lockout? Our builder rated rainy days as 3mm (each builder is different). Inclement weather delays can impact the overall build time regardless of what stage they are at (example - even though house is locked up inclement weather can affect, site access, trade availability (in terms of delays to site), and OH & S requirements ). Page 32 of the HIA contract should they go over those allowed days they may claim them as an extension to the contract. The clause does not make mention to the amount of days they can claim, the requirements of the inclement weather or stages of construction, other than to describe it as "inclement weather". Quote: - what about in regards to our pool being put in by a pool builder during the build - what terms should I look out for there? I don't want them to use that as an excuse for the build site to lay dormant for a month! Can't help ya with this one other than read what the contract says about this. Quote: - I think we don't really mind about progress payments, we're happy with whatever the standard progress payments are.. Our bank demanded progress payments as per standard HIA contract and our builder was happy to do that even though they had modified it to be front heavy originally. Remember you are the customer, they want your business. Quote: - should there be a clause in there about what happens should the builder go bust?? They've told us they are in a scheme where another builder would take over and complete for same cost but how should that be stated?? Research, Research, Research and only make progress payments with the stage is completely finished and inspected. Quote: Any tips?! This thread is a great help http://forum.homeone.com.au/viewtopic.php?f=31&t=5823 You talk about deletions, are they variations or PS and PC adjustments? pleas list them 1 16565 I've decided, after a period of confusion (my building broker told me it's probably not worth it to use a lawyer, but others have said it is a must) that I definitely will… 7 27955 |
