Browse Forums General Discussion 1 Sep 27, 2013 5:07 pm Just a quick one. the block next door to ours started their earthworks last week and dumped two massive piles of dirt on our land. They have since taken back a bit of it, but there is still a whole heap there. Given they've used some but not all of it, is it time to call the office of their (*awarded most professional builder however many years running" volume builder and *ask* them to remove it? We should be starting in the next few weeks and I have enough of my own dirt to worry about without them adding to it! I'm not being a PITA by complaining about it am I? I just don't want to get all worked up if its some sort of unspoken rule that its ok to do that? Surely there would be no such rule.... Hmmm, I think I'm overthinking things! I would speak to the Builder and have them rectify this immediately. If they are such a reputable building company, take a photo of the soil they dumped with their advert in the background and send it to them, and threaten to send it to everyone and anyone even newspapers. They fully know what they're doing so i would act accordingly With all your excess soil from your build, id be putting it on their property wherever it would fit (front yard, backyard, loungeroom) How would they appreciate that? Simply ring the building company and explain the situation and ask that it be rectified. Take photos etc, I am curious how one proves that it is infact dirt from the adjacent block and not another builder. I would start nicely and see what happens. I think that if they are as reputable as they clainm that it would be sorted pretty quick. It is likely their sub contractors. Oh and the "karma" suggested above is not the answer and will only invite trouble, in my opinion. Re: next doors builder dumped dirt on my block 4Sep 28, 2013 11:52 am In perth it's a pretty common occurrence to use vacant blocks near by for sand etc. The builders clear it out but you can just give them a call and explain the situation and I'm sure they will remove whatever needs to be taken away. Don't need to make threats and get angry...just make a simple call. If you don't get anywhere then contact your builder and they can have a go or maybe they won't even see an issue with a bit of extra sand and will say not to worry. My mate had the same issue, the builder left the soil from the slab and cut in excavation. They said they would remove it as soon as the slab was poured, which didnt happen. Then next-door constructed the frame and roof and still nothing was done. My mates build was delayed by just over 3 weeks because they couldn't start with all that soil on his block. When he threatened them with legal action they laughed and said dont worry well get rid of it. When they did remove the soil they only removed 3/4 of it and spread the rest all over the block. My mate end up paying $1600 to remove the soil and took away 9m3 bin overflowing, thats a nice start to your build before you start. End of the day, its not what you know,but what you can prove. Not sure if the first one knew. But - they can't come on your property - even to build a zero boundary wall - unless they have approval. They also can't use your water or electricity ... Re: next doors builder dumped dirt on my block 8Oct 01, 2013 3:27 pm I spoke to the supervisor today and he said it will be gone by Monday, Tuesday at the latest - after their slab pour on Friday. That should be just enough time for it to be gone when we start, Unless its the same builder who built near surfprado's mate! Then we're screwed! Not sure what they would have done if our site was fenced up already - they've got their polystyrene now sitting on my block too. Their house pretty much fills their entire block. Oh well, as long as its gone before my temp fence goes up I'm not going to loose sleep over it all! Re: next doors builder dumped dirt on my block 9Oct 05, 2013 9:44 pm Yeah good result in the end as I was thinking it wouldn't be too much of a drama if you were to go about it the right way and calmly ask the builder to remove what ever it is they've placed on your block! I don't think that I'll have the same issue as you only because the house to the right of our property is fenced already and the one to the left is only 2 weeks or so ahead of our build.....could be wrong though Re: next doors builder dumped dirt on my block 10Oct 08, 2013 12:29 pm I knew it was too good to be true - they didn't remove the dirt, just spread it over the block. Its Porter Davis incase anyone is interested. Short of billing them for a portion of our soil removal costs there isn't much else we can do. It's so unprofessional. Re: next doors builder dumped dirt on my block 13Oct 09, 2013 11:48 am I think I would be tempted to send them them a letter (via normal post, fax and email) stating that you are formally requesting the dirt to be removed by a certain date (7 days), if the dirt is not removed by this date you will be billing them for the removal of said dirt and the cost of returning your block to it's former state. I would also be stating that you have not given permission for their staff or representatives to enter your property, and if anyone is found entering your property you will be taken legal action. I wouldn't worry about it unless it does actually hold your builder up or they charge you for extra soil removal. We have a couple of piles on our block that I asked our builder about and they said they will be removed when excavation takes place at no cost to us. Maybe its because they are the only ones building where we are and as ours is one of the last blocks in the street its been used as a bit of dumping ground. But not to worry, I've been assured that it will be removed at no cost to us. Not our fault. Have you asked your builder what happens if it is there when they start? maybe it wont even matter. In my opinion they should have never stepped foot on your block, and since they have dumped waste on your block its only right to remove it asap. When working with YOUR builder they are usually looking after your best interests because you are the customer and your writing them the cheques, however if you have no interests with with builder, then you usually have no leverage with them and i find knowing your rights and using them is the only way to solve these types of issues Never argue with an idiot. I haven't seen it myself, ill admit, but I wouldn't blow it out of proportion. Is it really going to affect you? They'll probably sort it out when they excavate for your build. I know it's not the neighbours fault, and it's not a particularly gripping issue, but it's frustrating none the less. There were pot plants, bottles, road base and dirt on my block. They even put the roof tiles and bricks on my block as well. I wasn't too impressed at all but let it slide. I just thought it was rude and inconsiderate to not have asked me. Also, whose to say I wasn't about to start building as well. It was all cleared with the exception of a pile of road base. Then a few weeks later another neighbour put piles and piles of their dirt in my yard as they were landscaping and had cleared the yard. They used my block to get the kanga into their yard and even made a ramp out of dirt with it (there is a 2 metre high retaining wall) and removed a part of their fence to do it. I went to the sales office and mentioned what was going on. She suggested I go and speak to them myself. I didn't.
