Browse Forums General Discussion 1 Sep 26, 2013 7:31 pm Im looking at buying a block in Tasmania which has a power pole at one corner, the lot plans show a wayleave Easement moving along the block gradualy getting wider as it comes to the pole. I cannot find any information anywhere to do with wayleave easements. Basically all i want to know is can you build on the border of an wayleave easement(still taking into consideration the normal setbacks) or is there a setback from the easement. Obviously I dont want to build right on the pole but the easement does flow down the side of the lot. If its only like a 1 meter setback from the easement thats not too bad but if its like 3 meters etc this could be the difference from buying or walking away. Thankyou in advance anyone that can help Re: Wayleave Easement 4Sep 27, 2013 6:40 am I'm not sure of the exact rules governing a wayleave easement ( all I know is that it pertains to electrical companies access to their assets like poles substations etc ) but generally you are allowed to build up to the edge of easements. There are usually no setbacks. This here may help... http://www.thelaw.tas.gov.au/print/inde ... 0000;rec=0 Stewie You should be able to encase the sewer but you will need it designed and approved and access to lot 580 to do the work 2 17168 You might be able to apply to divert the sewer at your expense. In NSW you would contact a Water services co-ordinator and they would give you advice as to whether or not… 1 16150 Thanks - yea sounds like I need to submit build over easement application....ugh guess I better start finding someone who can do the engineering drawings 3 3387 |
