Browse Forums General Discussion 1 Aug 19, 2013 10:21 am We have finally decided to own a home and currently living in a rental property (about 6 years here so far). We are in the process of building which may overrun our current lease by 2-3 months. When should we tell our landlord we are building/moving? We are currently in good stead with the rental agency. From our contracts they have to give us 2 months notice and we have to give one month, but I guess I am worried about being shot to the curb before the new house is ready. What are people's experiences with this? Austex Re: When to tell Landlord you are building/moving 2Aug 19, 2013 11:02 am Don't say ANYTHING until your house is built and you can move in. Then give a months notice. You'll need it to move in anyway. I found that delays in building buggered up our ability to negotiate payment etc with the builder due to the fact that we had to be out of the rental by xxx date. Re: When to tell Landlord you are building/moving 3Aug 19, 2013 3:05 pm We're wondering the same thing. Can we sign a six month lease but break it early if we give a month's notice? I'm not sure how these things usually work. I would hope that 3 weeks out from the finish of the build you would have a fairly definite end date wouldn't you?.... then you could give a month's notice on the rental property and have one week overlap? You usually only have to give 2 weeks notice before you vacate when you are on a periodic lease. Then allow a few weeks for moving & cleaning etc. They should be able to give you a set date at least one month ahead. As a landlord, I prefer an initial 1 year lease then I don't mind month to month. I hate to get a new tenant who would then move out in less than a couple of months but the RE agents love it as they can get more money out of it. Re: When to tell Landlord you are building/moving 8Aug 19, 2013 4:53 pm Best thing is to check with the relevant state authority regarding the legal notice requirements. eg, See here for Vic Consumer Affairs - unless you meet certain other criteria, you must give 28 days' notice. ~ Anne I used to be indecisive but now I'm not quite sure.
