My partner and I bought a block in Byford last July from a private seller. It was one of the original blocks on the Scarp so it didn't have any changes from the developer.
We are just getting started to build and the builder has found that the water table is higher and so therefore we need to add in a subsoil drain, extra site works etc. The advise that this wasn't evident when they first did soil testing as it was completed in January and therefore no water would've appeared. Is this correct or should they have picked this up then?
We are now looking at having to spend another $20000 to get a subsoil drain, extra site works and now a retaining wall in.
Do you think that the developer (Aspen) would be liable to this as they originally sold a block which was not fit for use? We can't be the only block in the area that has been affected by this. From looking at the other blocks, these seem to be have built up due to this reason.
