We are close to the completion of our house and as such our site fence has been removed ready for the driveway to be done. This is not a problem.
Our problem relates to the fact that the fence that was separating our build from next doors was a fence paid by my builder and as such has been removed. The builders next door have not installed a new fence to separate our two blocks (it has been at least 3 weeks now, even with my SS telling them twice that they needed to put up a fence).
As their block is ALOT higher than ours and they are only at bricking stage, I am worried that debris, building materials, mortar, concrete etc will be dumped/splatted on my block. Not only that, but the scaffolding that has been erected is protruding onto our block of land as well, which will be an issue when we get to settlement and landscaping.
Are there laws governing builders on the erection of site fences to keep their builds within the building site? What are my options if a fence does not get erected soon? Can I complain to council?
