Our planning permit to build a townhouse in the backyard and sub-divide has been rejected by Melbourne Water as the property is covered an SBO and is highly prone to flooding (apparently street can flood up to 900mm). The architect handling our application has never encountered such an objection as SBOs are common in Bayside, Vic and usually get approved subject to conditions. Appreciate any help. Thanks!! Here's an excerpt of the response. "The property is subject to high flood risk, where the depth of floodwater on the site is predicted to be up to approximately 900mm in a major storm event. Melbourne Water does not support development where the depth and flow of floodwater affecting access and egress to a property is hazardous. Melbourne Water requires any vehicular and/or pedestrian access to comply with the following safety criteria: (A) Depth of flow does not exceed 0.35m; (B) Velocity of flow does not exceed 1.5m/s; (C) The Depth Velocity product does not exceed 0.35 m2/s. This requirement is designed to ensure that people moving about on a property or accessing the property during a flood event are not endangered by deep or fast-flowing water. The flood depths within Poole Avenue are expected to be in the order of 1 metre deep. It should also be noted that the property and its access points will flood to a depth that is considered unsafe in not only the 100 year storm event, but also in the 50, 20 and 10 year storm events." It's disappointing and we're at a loss as to how to go about it, they did mention to the architect that they would support it if we built a mansion on the site but not a subdivision. We purchased our block we plans approved, but we did want to make the house a fair bit larger; we also knew that there were a large number of neighbours who had objected to the past owner builder the original (smaller) design - to the point there was a towm meeting held in relation to our house. We used Urbis, they were not the cheapest planners around as they seem to deal mainly in larger projects ... But honestly I can't recommend them highly enough. They research what we could and couldn't get passed, they then told us the chances (and risks) of getting our various ideas passed council, and recommended what they thought met our needs and those of council. Once lodged at council, we had our permit within 3 weeks - they even somehow bypassed the advetising to neighbours as it was only a 'change' to the current permt, not a full new one Flamingo Give me a call and I will do my best to talk you through it.
