Browse Forums General Discussion 1 Mar 22, 2013 7:19 am Hi Guys and Girls, My partner and I were going to build our dream home, which took 8 months in the making the decision. But having placed the deposit down and gone through a colour browse. Now its completely out the door. We were set to go as we had our land titled and the soil tests were underway. It hit the permits / Design Standards department and basically it was rejected because it didn't comply with developer guild lines. I'm not a lawyer or design standards guru but there surely has to be a away around this right? have a look at the Page I've attached the design standard that has thrown this all out the window. Pretty much the builder came back to us and said because the way your alfresco sits it doesn't comply with the DS, You need to choose a new house. We can't move the crossover because its already there. Where do I stand as we've fallen in love with this house and design and pretty much planned everything around it. Are there some flexibility in the DS or is it pretty much strict? Any help I'd appreciate it. The obviously aren't very familiar with the Riverwalk estate. VicUrban have very strict guidelines for that Estate, at one stage you couldn't have an 'alfresco' area at all unless you had an open roof The design you have chosen is lovely but it doesn't use the orientation of the block to it's best potential. Have you contacted VicUrban directly ? That plan as positioned ( with bedrooms on Northern) side has the worst possible passive solar orientation. Try putting the cost of changing the crossover back on the building company as their sales consultant has obviously not been au fait with the requirements pertaining to your block. Good luck. Sure, it's facing south and tilted at 22.5 degrees but the skylight will add much light. We had to do this with our north facing al-fresco due to our tiny block as Vicurban required a certain amount of light. Have you contacted VicUrban directly ? Nope haven't contact them as yet. But CH has and there are a few things that needed to be changed in order to meet their guidelines. I also pointed out that there is a house that has been just built across the street with the same problem as us and they seem to have their plans been approved. So the plans were sent to the developer (Places Vic formerly Vic Urban) and the permits and design standards department pretty much stated that our house will have little natural light in the main living areas. We understand this but the we're more looking at the floor plan of the house. We didn't reverse engineer this as we bought the land about 6months ago with no plans to build for 2 years. But its come to the point where we had to make the call and start building. The only reason why the plan was Pre Approved because of the Activity room. however we do need to make that room window as big as we can get. Not so bad after all. In the end we shrunk the house down lost a bit of entry portico ( it was huge anyway) and the rooms were shrunk slightly. There's usually a way around it you just need a good rep to figure t out. It sometimes takes a lot of thought and care, and consultation, to work out satisfactory resolutions but with 3 D software, care, and skill, it can be done. Never give up! Not true Leighton-our daughter and her husband faced a similar situation with a volume builder and not only was it easily resolved, but their build was quick and trouble free with them moving in last December.
