Browse Forums General Discussion 1 Jan 11, 2013 7:15 pm I know there are heaps of these threads but I had a quick question.. Can fencing be done if one neighbour concretes to the boundary? Can they still do the posts or do they have to be moved in to our side? We have been waiting ages to get one last side of our fence done as our neighbour was building on the boundary, and they are finally done. Now we are eagerly waiting for the fencing company to do it but the neighbour has said they will be concreting on the side of the house to their boundary next week and if the fence isn't done it will cause problems. They said the fencing company might move the fence in a little. We don't want this as its already a narrow side and that means we will lose a fraction or our land. Anyone been through similar? I've heard where one party actually sells a tiny portion of land to the other - but it sounds a bit silly to me. They will be your neighbour so a good decision is worth thinking about - before you start the jack-hammer ... What are they doing for drainage on their concrete? just letting it flow into yours? thats not allowed. They will need to place something along the side of the fence to either collect the water or stop it from flowing over. We had a neighbour who didn't want certain things with the fence. I found out he had real drainage problems and was planning to run the water (in a rainstorm situation) down his driveway and into the back - along the fence line - and guess where then !!! I made sure we had pine sleepers under - which gave it more height - and stopped this planned flow. It worked well. He spoke to my partner and basically told her they are concreting next week and if the fencing isn't done then it will probably have to be moved in a bit on to our land. Of course I will refuse this. My neighbour concreted over his drain, I had to get the council involved. It was a nightmare. I have a drain now running down his side of the fence, and it pipes into one of my drains would you believe.
