When I got home from work last night I had a Notice to Fence from the neighbouring block to install the colorbond fencing that is required at Manor Lakes. As neither of us have built yet, my first reaction was wtf. My first reaction was "this is just going to get in the builder's way". I spoke to my Construction Manager today and he had the same reaction that I did. As my fencing is included on my contract he asked me to send him the notice and he'd take care of it. I have to wonder what the neighbouring owner is thinking though as it's not much use putting up a fence if the builder has to pull it down to get access. My garage wall is on that boundary as well and the quote is therefore incorrect. If anyone else has had this happen, I'd be interested to know what the outcome was. Fencing does come under the dividing fences act which will govern the whole of Aus but councils and developers add their own bits in where they like. The dividing fences act states that you can not be require to erect a fence until "the completion of a substantial building." key word here being completion. Nothing further has come of it - neighbour's house is going up at the same time and he's about at the same stage that I am so I guess the fencing will be going up shortly. I told him in a polite letter that was fine as long as he cleared his building cr*p from my block (temporary fencing, broken bricks which suspiciously matched his, and a mound of dirt that I saw his contractor bobcat across). I was worried that my builder would probably charge me for moving the junk he's left on my block....this happened to my brother. Incidentally, he rang me and had a winge about how he might get broken into, I told him if he didn't move his "materials" I'd talk to council. Building a fence before the house sounds wierd maybe someone at that company got confused about temporary security fencing? Back on topic, have you heard back from your builder? After seeing what damage the council did to a nearby property, I would be holding off until Site Clean. I heard the owner arguing with the council rep, who asked if he could prove it. I gladly said hi, and asked who's lawyers would like the stat dec?
