Browse Forums General Discussion 1 Sep 19, 2012 1:36 am Hi guys, just would like to seek some help. I am in WA just recently had retaining walls done for the front elevation. The contractor refused to draw a sketch and did not provide me with an invoice with GST on it, all hand-written. Now, the problem is he missed about 70cm of retaining wall towards the pavings, because he reckons it does not look good. So at the moment there is a gap between my paving and retaining wall. I have asked him to come back and finished the job but he refused to because he was saying " I have done the job wi such a low price and you live too far away from me". At the moment i still have some money that has not been paid to him. I have requested that i will transfer the remaining balance when he completed the job. But he does not want to and threaten me that he will undo and take all the retaining walls he has dome from my property if the money is not in his account in 3 days. Can someone help me? What to do at this stage? Cheers, Richard Re: RETAINING WALLS 2Sep 19, 2012 3:09 am If he willing to come undo stuff why can't he come finish his job!?! Sorry I dont have anymore advice. How infuriating! Re: RETAINING WALLS 4Sep 19, 2012 7:48 am Quote: The contractor refused to draw a sketch and did not provide me with an invoice with GST on it, all hand-written. So he is probably unlicensed , uninsured , didn't give you a formal written quote with his licence no, ABN nor contact details and asked you to pay him cash right, all without a dimensioned plan or elevation that you should have provided for him to quote off ? Hmmm... Stewie Re: RETAINING WALLS 6Sep 19, 2012 9:33 am LeanneR If he willing to come undo stuff why can't he come finish his job!?! Sorry I dont have anymore advice. How infuriating! I know, its so annoying. Re: RETAINING WALLS 7Sep 19, 2012 9:35 am Yes he prefers to get his payment in cash but i paid $1,000 by EFT and $700 by cash. Now there is still $1,000 left that he wants to get but the job is not what i wanted and if he drew up at a sketch with all measurement it would be much easier.! Anyone reckon that he can undo and take all the bricks work he has done? Re: RETAINING WALLS 8Sep 19, 2012 9:57 am Dont pay him a cent more. Surely theres someone you can call about d0dgy businesses Re: RETAINING WALLS 9Sep 19, 2012 10:07 am Stewie D Quote: The contractor refused to draw a sketch and did not provide me with an invoice with GST on it, all hand-written. Stewie Thanks for your reply, he gave me an invoice vis email but its all just written as part of email as in he typed it and just writing down his ABN on the top but there is not any GsT component that i can claim back. He just said "i dont do drawings and price is already lowered for you!" again he said that. Re: RETAINING WALLS 10Sep 19, 2012 10:10 am LeanneR Dont pay him a cent more. Surely theres someone you can call about d0dgy businesses I am not sure who to contact and stuff, he also left all his rubbish on the empty lot next door and the owner of the land (because it just settled) wants me to remove it. Now, if he does not want to come back i will need to extend my paving and it costs me another coins. I am just afraid that he would come back and start wrecking my property, which will cost me more than $1k Re: RETAINING WALLS 11Sep 19, 2012 10:34 am If he comes back and wrecks things it would be tresspassing Re: RETAINING WALLS 12Sep 19, 2012 10:41 am LeanneR If he comes back and wrecks things it would be tresspassing Thats true! But the retaining walls that he done is at the front of the house, i dont know if that would count as trespassing. Re: RETAINING WALLS 13Sep 19, 2012 11:02 am As far as I'm concerned anyone who goes past letterbox is on my land. Hopefully he isn't that syko. He would still be damaging property that's on your land Re: RETAINING WALLS 14Sep 19, 2012 2:00 pm I have just got a message from the guy. Now he said he will charge $200 to complete the job. He wants the balance paid tonight. Then i told him that i will pay your $800 then, and thank you. Now he threatens that he is going to call the police.!!! Is there anything can be done to protect me as the client? Re: RETAINING WALLS 15Sep 19, 2012 2:05 pm Do you mean he will charge extra $200 on top of $1000 you owe. Perhaps call local police and ask them? I have no idea who you can call. Fair trading? Re: RETAINING WALLS 16Sep 19, 2012 2:06 pm Yes so if i wanted that the retaining wall extended it will be $1,200 that i will owe. Re: RETAINING WALLS 17Sep 19, 2012 3:50 pm What's the police going to do? This is all civil not criminal. Sounds like another rouge tradie (all respect to non rouge tradies). *MrsG* makes an excellent point about taking photos. That way you have evidence especially if he does anything else. Be stern and strong about your demands: 1. Extend the retaining wall 2. Remove the rubbish from the neighbours Then he will get paid his $1,000, no less no more. Re: RETAINING WALLS 18Sep 22, 2012 4:01 pm I would call the building commission in your state for advise. http://www.commerce.wa.gov.au/Corporate ... aints.html Make sure you take plenty of photos before he's allowed back on site and don't pay a cent more until the work is complete. Re - GST he may not be registered as his turnover may be under $75k a year. You can check this by going to the abr website and searching for his ABN. https://abr.gov.au/ABRWeb/Homepage.aspx ... id=71&js=1 Jem's Custom build - viewtopic.php?f=31&t=58630 Re: RETAINING WALLS 19Sep 22, 2012 11:26 pm This sounds awful. I would calmly ask the builder to finish the job. You've got his money, therefore you have the upper hand. Demolition August 2009, Construction Started September 2009, Completed December 2010 Re: RETAINING WALLS 20Sep 23, 2012 7:04 am Lesson for everyone.. DO NOT USE A TRADIE WHO CANNOT PROVIDE PAPERWORK. So many of them. Neighbour had a driveway done by a 'rogue' concretor. Ended up having to have her garage door replaced, and front bricks re-cleaned, as they put wet concrete all over them. Render your bathroom walls, two opinions versus the one, makes you wonder. 3 6046 The spacing of the studs looks pretty large especially for a load bearing wall. 3 11106 Nope, only on the inside, I've literally has my ears to the brick outside and can't hear anything. I can sort of 'reset' the noise by pressing firmly on the studs. This… 10 11736 |
