I was actually hoping for an earlier settlement date than Oct 8th and my broker and bank were great, but my conveyancer let me down. Now I am booked for settlement on Oct 8th, so not an early settlement after all!! ::angry::

Not sure about council rates, but i know that you dont have to start paying body corp fees until they open the Residential club. Which, by how MW likes to do things, could be years away!

Well, when I spoke to the conveyancer to ask about how to pay the stamp duty (ie with the loan or raise the money ourselves), she answered those questions OK, but then when I said were just waiting for the bank to get back to us re valuation (she had the plans/quotes from the builder), the conveyancer said "why is she doing valuation?", and I said it was because that's what we'd been asked to do. Not sure if the bank staffer knows October 8 is D-Day (my lack of knowledge made me believe it was 2 weeks from that date !) - so we have contingency in regards to the stamp duty, but hope the communication lines get cleared up in time.

As for the MW rates, that's a bit of breathing space !

Paul, hasnt the bank done your evaluation yet for the house and land? We did ours about a month ago! It could take a while, depending on how quick your bank works. I hope you can make the thursday settlement date. Yes if you apply to villawood once the land titled (25th Sept) for an early settlement, then you are able to settle at any time, you didnt have to wait for the Oct 8th day. I tried so hard to get things done so we could title earlier but it didnt pan out that way, mainly coz i had to chase up my conveyancer to make her do things! I'm not that happy with her services! Thank god i dont have to deal with her after settlement.

If you scroll back to the previous page I posted an update about the resident's club and community hub. But in brief, they are talking about moving the RC so it may be further away than previously expected. The only good thing about this is the fact that we won't have to pay the $900 until it's all complete

With regards to council rates, you are liable from the day your land titles. At first you will be charged land rates only and this changes when it becomes your place of residence (eg when your house is finished). I am still waiting for my revised rates as they haven't acknowledged us moving in yet, so the land only is currently costing us $145 per quarter.

That doesn't sound very fair having to pay rates when you don't even own the block yet! But maybe that is how things are done when you buy off the plan. Ours was a resale block so we weren't liable for rates until the block settled. Maybe someone who bought off the developer can help clarify?

Yea, I bought the Land seperately and my broker said that i dont have to pay until the land title. also the Land mortgage starts after the land settlement. not sure though. I will wait till they ask for money.

AND they make us wait an extra 6 months due to delays on land, which meant thats an extra six months of rates and landtax that we had to pay, as well as copping an extra $6k from my builder because of the land delays!! ::angry::

Seems like it's lose lose for us, and win win for them!! ::angry::

Yep feel sorry for all of us as most estates dont do this!! ::frown::

That's right, from the day you buy the land to the day of the settlement, you are charged a percentage of the rates and land tax that villawood accumulates.

From what my conveyancer told me: Villawood has to pay for the rates & landtax for the whole estate. So what villawood does is divide the price (rates & landtax) into the different stages, and then uses this number to divide it amongst the so many lots in that stage, and also by how large your block is, and then they come to a figure which you have to pay on settlement day!!

Then once the land settles, you will take ownership of your land, and begin paying rates on your property only.

I totally under where you’re coming from, we were looking at a block of land in stage 9 and in the contract we were told that we would have to pay the developers land tax. We had Mia send a copy of the contract to our solicitor. We also sign the contract and had the cooling off period, in this time we show our solicitor the hard copy of the contract and she found that the copy Mia had sent her about the land tax was a different figure to what was on the contract we had signed, with a difference of 14m, our solicitor also told us that the contract was a very strict contract and that it only favoured the developer. We were told if possible try to buy titled land so that would excluded us from paying the developers land tax and just pay your rates.
We wanted to live in MW and it was a blessing that there was a block of land for sale in stage 3 which the owners were desperate to sell, we ended up paying the same price as the land we originally going to buy of the plan and even saved on paying the developers land tax. :z:

Please let your solicitor read the hard copy of your contract as there are a lot of loop holes in it which favour the developer.

There are still blocks available in stage three and on realestate website there are ppl selling blocks (not cheap)

But on the upside, your land has probably gone up in value since you signed the contract so you are most likely already ahead

Just as an example, blocks in our stage are now selling for at least $35k more than the original purchase price.

Yea the land contract really does favour the developer. I told a few of my friends this and they were shocked. They've never heard of such a thing!! Hels, i guess I will just have to take comfort in knowing that the land has increased in price since i bought it. But its so hard to sometimes because they have made us wait so long for land settlement, its been 18months since I first bought the land!!!! :shock:

It just sucks how the developer doesnt follow through with what they promised (of a feb settlement) and yet they bear NO consequences! Luckily the FHOG got extended or i would be fuming!!

Thanks guys, i think i just need to have a rant!! At least now if someone is considering buying land in MW off the plan, and they didnt have anyone look over the contract, they will at least be aware that this IS a clause in the contract. Now they can make more of an informed decision. The thing is, even if i knew about this beforehand, i still would have bought the land. I love the look of the estate and all the plans for it. But because I hadnt known, and only found out a few days prior to settlement, its abit of a shock!

S&P, íts been so long since ive been talking about my house, i cant believe i might actually be building it!!

Hey Wonderland, we copped that land tax too, not as much as you did but still - I think its disgusting - especially when they remove it out of the contracts if we have a soli or conveyancer smart enough to pick it up at time of signing!! I think there is some info about it (more just ranting I think) on the MW community site and the guys in stage 1 and 2 wrote about it at the start of this thread.

Hi guys

Need help on this issue, we are about to start building very soon, my neighbour is requesting for a fence to go up, which I can understand her reasons. She also was saying to us that she needs a fence up before her first three months are up.
We are against putting the fence up as we are about to start building and it could get damaged during construction of our house, also being a corner block our garages butt up to each other and I don’t know where my garage wall is going to end up all along the boundary line once it’s finished. Should we just wait until our SS contacts us and asked him if we should build a fence or this matter won’t affect the builder? Any suggestions???

Ask your neighbour if she minds waiting until after your garage wall is built? I am assuming that your house is not too far away from starting though?

Having a fence up whilst building shouldn't be too much of a problem. We had 1 side fence up and our house is only 1.2m away from it and it is fine. I actually wish we had done the other side too before building as the ground level is now very uneven on that side, not to mention the fact that we have been waiting since July for the damn fencers to turn up!! :roll:

Hi guys

Need help I think our builder has stuffed up and is trying to get out of it.
Can anyone tell me is the front setback of 5meters for the house, is the measurement taken from the Garage or the Portico?
In the building guidelines of MW it reads, setback of 5 meters from garage.
As the builder has our house at 5 meters from the Portico not the garage, and if we want the measurements to comply with MW building guidelines they’ll have to go back to the drawing boards and start with, Re-Submitting Building Permit, Re-Submitting Developer Approval and even charge us a Variation Fee and Engineers Fee, when they did the measurements and got it all wrong.

Can they do this to us??

Our house is 5m from the portico to the boundary, our garage is set further back as that is the layout of our floorplan.

Are you saying that your garage will be more or less than 5m from the boundary? if it's more than 5m then it's not a problem.
