Browse Forums General Discussion 1 Sep 08, 2012 3:04 pm We built with a major volume builder and to cut a long story short, now have to take them to VCAT. They are non-compliant with a Consumer Affairs agreement that they entered into with us, and in that agreement the Building Commission Civil Engineer found the problem with our house to be their fault. I am claiming compensation from them and have been told I have to do this through VCAT. Does anyone have experience of VCAT where they were awarded damages? I would really love to talk to you! That is a good opportunity to get a negotiated settlement but you have to be well prepared and supported and coached. Recently I have done a VCAT report(with cost to rectify) for one of this forum members. He was well prepared, went to VCAT mediation and settled with the builder for a substantial sum. Many of my clients have done well in VCAT hearings and in mediations but some did not. For the best chance of success you will need professional help.
