One of the houses behind us in Brisbane has had to do significant cuts on their sloped block prior to building their house. There house has been completed for a year or so. The only retaining that they have done is one meter wooden retaining walls around their yard . On the right side of the house... the cut is 3-4 meters with only a one meter retaining wall right on the boundry. On the back of their house.. the cut is about 2 meters with only a one meter retaining wall right on the boundary. The cut on the left side of the hosue is one meter with a one meter retaining wall right on the boundary with no drainage behind it so that the storm water washed right over it into our back yard and our next door neighbours yard. My question is are they allowed to do this? Are they allowed to have 2-3 meters of unretained land that was cause by their cutting. There is not yet a house on the block of land that shares this boundary.. but surely it would make their land unstable for building? THey can't retain back any further because their retaining wall is right on the boundary. Are they allowed to change the flow of stormwater due to their retaining wall construction and cut of land? If they did then it should meet all laws at the time, I would think council would have checked plans and actual for compliance! If it's an 'illegal' build then it's possible it's all wrong! But I would guess that if they dug down 2-3m and have 1-2m of un retained earth that, that probably is not safe or permitted! They told my partner that they were doing it themselves rather than going through council.. which is why they can only go one meter high. You can probably only build a 1m retaining wall without permits, but that doesn't remove the need for a larger wall!
