Browse Forums General Discussion 1 Jun 26, 2012 9:16 pm We moved into our new estate house and now my neighbours are building with a project builder. With the neighbours house 1m from our boundary when they had their site levelled the soil was pushed over into our block by 500 to 1m for the whole 35m boundary, 200-400mm above natural ground. We new they would appreciated level access around the slab during building, so only mentioned it to owners, that there builder would need to eventually move it. During the build they have had very poor communication with builder apparently. The house is at lockup and we want fencing done. I have asked the builder on two occasions now and email that they must remove the 'dumped' soil and given deadlines. They keep stalling, I speak to new people each time and retell story, they are looking into it, I ask for reply call that doesnt eventuate. They have said it is the owner not the builders responsability! I have now put off the fencer for another week. I have told them that my fencer will charge if he turns up again and he cannot instal the fence. There is retaining that neighbour is paying for but it will leave the excess dirt on my side if continues.What should I do? They hired a dingo and moved it back onto the other side and then sent the invoice for hire and time charged their personal labour at $50 per hour, When the project builder ignored him again he paid the $50 and took them to small claims court. Once the project builder received the court documents it was only a matter of weeks until he receive a check for costs. This was in SA btw. You could take your complaint to relevant builder licensing authority and ask that builder's conduct be investigated. That should do the job for you. Good luck. I hope this has not caused any ill feelings between us as I am sure it shouldn't be their problem, but should have been done by the builder. Don't want to get off to a wrong start with new neighbour.
