Browse Forums General Discussion 1 Jun 06, 2012 10:09 am Hi All We recently purchased a house and part of the negotiations was to have a leak fixed and the ceiling fixed, the previous home owner did this under their insurance and seem all done. However the leak is clearly still there as mould is back in the exact same spot, does anyone know if this still falls under the previous owner claim or is it now responsibility? Any help would be appreciated Thanks Re: Home insureance claim - does it follow on to new owner 2Jun 06, 2012 11:28 am Because the mould has returned it doesn't mean the leak hasn't been fixed, it could be it was a poor cover up paint job. If the insurance company paid out on the claim its up to them to chase up who ever did the job to make it good. If you dont know the insurance company, contact the R/E agent, explain your problem and they may contact the previous owner to find out the insurance company. I think you will have to liaise with the insurance company to allow their accessor access etc. Arfur Re: Home insureance claim - does it follow on to new owner 3Jun 06, 2012 12:25 pm Thanks Arfur, When we settled we got a copy of the claim etc which had all the info, so I called the RACQ and got a nice lady who said she would pass it on the claims dept. I got a call back from an abrupt lady who said it was none of my business and would not even let me know how to proceed, shame really as I was reaccessing all my insurance and got a quote from them the day before based on the first call experience. I dont think the RE is going to care to much due to the terms we put in the settlement as they are one of those turn over cheap type RE's. He was hard enough to get hold of when were trying to sort things out originally. I spoke to the people that fixed it and they had a look whislt I was out which I beleive they did and said they had completed their scope of works and that it wasnt accessed properly ie: the leak wasnt detected properly and assumed it was something else. They said a pressure test of some sort should have been done. This leaves me at a roadblock. I think you might have to try the claims dept again, perhaps even a personal visit armed with photos etc, and hopefully not get the rude person again, because its between them and the repairer. Failing that I would write to the claims manager highlighting the poor service you received and suggest if they wont assist you you will try the Office of Fair Trading next. He seemed fair on the phone and actually told me off the record it was not accessed correctly originally. As for the insurance company, if I ring back I would get the same person as it falls under her accounts. I wont be giving up though, its the principle of the situation that annoys me.
