I am having some problems finding a definitive answer on the internet so hoping somebody from this forum can help me.
Basically my question is, if you are doing a renovation or a new build using the SEPP either as exempt or complying development, do you also have to comply with the council DCP.
For example, Ryde council has a restriction in their LEP that you can only have two car spaces on the entire property. SEPP is more concerned about bulky garages at the front of the property. Under the Ryde DCP, unless they agree to give you an exemption, if you already had a double garage at the back of your property, they would not allow you to also add a carport or another garage. However, I can see no such restrictions on the SEPP.
Also, the SEPP mentions you can put in a carport up to 25m2 without approval, but is this still the case if the DCP says you can only have two car spots and you already have a garage?
Basically I already have a garage at the back of the house and I want to add another one or carport....
