I need help please with this very serious issue regarding our colourbond roof colour. We chose surfmist for the roof. Three months after moving into our new home, we receive a letter from our local council that surfmist is not an approved colour. i.e we need retrospective approval from neighbours because of glare, or change the roof/colour to a colour other than white/zinc/surfmist.
We had design and planning done by a designer. The building was completed by a separate party. I emailed the planning approval documents to the builder. One of the conditions mentioned the roof colour to not be white/zinc/surfmist. At that stage we were looking at an off-white colour but had not know what surfmist was. 4-5 months after planning approval, we were offered surfmist as the off-white colour for the roof. We had no idea this was not an approved colour, and apparently not the builder either. The builder is taking no responsibilty for this. I had emailed them scans of the planning approval - so i know they received this. But this appears to be a massive oversight.
Who is to blame for this and what are my options ? I believe the builder had a duty of care regarding our building, and this was not exercised.
