We are a local heritage listed property therefore we don't meet the requirements for exempt development (everything else about the installation will). When the council assesses our application do they have to assess purely against what would normally be exempt plus the heritage impact or can they request us to do other work not directly related to the application as part of the DA consent (i.e. additional screening to prevent overlooking) as the DA would not be required if we weren't heritage listed? I just submitted a DA here in the ACT, and if your council is anything like here, they charge like wounded bulls! I would want to ensure it had a good chance of being approved, and what they wanted to see in it without the risk of losing the application fee, as well as ensuring you know what they will be looking for. I can't see it failing but the problem is I have a rather argumentative neighbour who has far to much time on her hands and complains at everything generally requiring more work (and therefore cost) than would normally be reuired. If I didn't have the heritage listing the spa would be exempt and not require any approval but because of the heritage it requires full DA, hence the question on whether a council can discriminate when a DA is required purely because of heritage when there is no heritage impact (i.e. if my neighbour complains and required $5000 of extra work do I have a leg to stand on with council)?
