Just wanted to get some advise from you guys in regards to my refund amount....
8 weeks ago I decided that I was not going to build now and asked my builder how much of refund will I be getting back if I cancel the contract. I was advised by the builder (through their Sales contact) that the refund would be $5,100. Note this was advised to me via email response for my query.
Based on that advise I did formally requested the builder to cancel the contract.
Up until early last week, there was no issue with the refund amount as I was told I will be getting the cheque posted to me. BUT, this morning I received a call from the Builder (Sales Manager) who advised me that the refund amount now is around $2,500 as they have now received a few more invoices in the last couple of days.
I am dumpfolded to hear that......I just feel like they are trying to squeeze a few more bucks out of me now that I am not building with them.
I told them that I will not accept this refund as this now seems to be misrepresentation on their behalf and also that based on their intial advise I have also committed with a tradie to use the refund amount to renovate my current house.
Happy to hear what you guys think my rights are in terms of them to comply with their original refund amount based on initial advise from them.
If I need to take this further what are my options??
