Browse Forums General Discussion 1 Jan 29, 2012 1:51 pm We have just found out that the retaining wall they we paid to get built at our new home damaged a sewer pipe. The retaining wall was built 6 months ago and had the damage has only just been realised because of all the rain we have had just recently. The retaining wall company is refusing any responsibility and actually had a clause in the contract saying they will not accept responsibility to any damage to underground services. So I asked the retaining wall builder for the certification that was done for the retaining wall as we were quoted for certification and charged for certification. The retaining wall was built on the boundary line and we told the builder originally that a fence would be built on top. The retaining wall builder is now saying because a fence was built on top he did not organise any certification. He did not tell us this and for the last 6 months we have thought the retaining wall was certified. He is also denying that we told him a fence was going to be built on top. Now not only do we have sewer problems but also a retaining wall that is not certified. The retaining wall builder is offering a refund on the certification charge but that doesn't fix my problem. I am about to make a complaint to BSA tommorro. Any advice on what needs to be done to get the retaining wall certified? Any advice appreciated. If the wall is under 1m, in Qld anyway it does not need to be certified. Also was the wall a part of your home contract? If so i'd be going to the builder first, it would be there problem. The retaining wall is well over 1m, close to 2m drop from the top of the part of the house. We have a split level home, we contracted the retaining wall builder seperate to our house builder. I have started documenting all discussions with the retaining wall builder via email since my investigations into this problem. I just don't have any documentation about us wanting to put a fence on top of the retaining wall so its his word against ours. However considering the retaining wall was done on the boundary line and the the height of the drop from the top of the retained ground I am not sure where he expected us to put the fencing to both neighbours property??? I will be contacting the BSA tommorrow and yes I have his licence number. Call the BC and also the local council. The council will send an inspector around etc and investigate and the BC should investigate. The fence ontop is irrelivant at this point, the permit/s and engineering are the main things to go after the installer for.
