Re: Neighbour taking the 200mm of our land 31Dec 21, 2011 12:44 pm Just thinking out allowed here, when erecting the entire fence which will be on the boundary there will be a 200MM (less share of the fence width) or so gap between boundary and wall. This would require a join in the fence so it would step in. it will look rather funny but I would ask the neighbours what sort of plants they would like planted there and purchase and plant them. Try and offer the hand of friendship and hope it doesn't get bitten, but Unlce above has summed up pretty well. Explain to the neighbour that there are legal complications and that in the interest of simplicity the fence will go in. Inivte them over for a cup of coffee once your settled in. Legal complications??? I wonder when was the last time someone claimed a 200mm strip of land as there own and it was gone forever. What could be more simple than stopping the fence at each end of the garage and forget about a strip on nothing that you can't use for anything anyway. If this piece of land is so important to you, next time you build put the wall on the boundry so the problem is solved. Arfur Re: Neighbour taking the 200mm of our land 34Dec 22, 2011 8:10 am man....seriously, why this type of thread always get so hot up. casa2 is right, although the neighbour does not need to claim it, they only need to prove they have been using this 200mm of land for the past 15 years and no one had raised any objection. they can simply pour concrete or fill with top dress and using it as part of their own property. they will need to hire a surveyor to re-draw the lot size in a few years time to include that 200mm and voila! they have your land. 9/10 times you will find out just after the 15years deadline. mgilla and Uncle Arfur, not sure which state you are in but in VIC, there is a 200mm off boundary line requirement, the 200mm space is meant for fencing, garden bed, pebbles, mulch, weed, or whatever crap you can put on it, it is a distinguish line to separate your block of land from your neighbour. to the owner of this thread, just build a fence it saves you all the trouble for now and future. the land is yours why bother giving it away, even Santa give toys only. Thanks rojak1, I'm in Qld and wasnt aware of the 200mm in Vic. Or is this just done to allow the fascia and gutter to sit on the outside of the brickwork and not cross the boundry line. Sitting the gutter on top of the bricks allows you to move the wall hard to the boundry. Costs a little more but is a pretty common practice here in Qld. But even in 15 yrs if your nieghbour does decide to spend the money to have his block re-surveyed, which would be a stupid waste of money in my opinion. What have you lost??? Yes on paper your block is 1.2sqm smaller, but even if you want to sell what possible problem could this present? Also if your nieghbour wants to concrete up to the side of your garage, say thankyou. Why leave a strip of dirt against your foundation where water can pound and cause potential problems. Refer to the CSIRO landscaping recommendations. So if that is the case it would be far better to have the concrete hard against your wall then the the water running off the edge of there slab 200mm from your wall. The fastest thing a builder will do is bank your cheque, those systems work perfectly with lightning speed, everything else is slow burn.
