Browse Forums General Discussion 1 Nov 28, 2011 9:25 am Hi All, In a bit of a trouble and thought of getting your advise on this. We fixed our fencing to be done with a certain fencing company (found through True Local) and paid him the deposit on 4th November. He asked us to pay $1400 for the material upfront which is more than half the total amount. We transferred the money to his bank account. After this deposit was paid it's been almost 3 weeks that he has not showed up nor returned our calls. We have already taken leaves from work due to him and wasted our time... What options do we have now ? Please help ! Cheers Re: Fencing guy no-show after deposit.. BIG mistake and I hope you haven't lost your money, although I suspect you may have. You should NOT pay more than a 10% deposit at ANY time. With my fencing I paid no deposit and paid in full by electronic transfer once the job was completed to my satisfaction. Perhaps a call to the Fair Trading Dept (Consumer Affairs) but they are fairly useless now Good luck, you will certainly need it. Arfur Re: Fencing guy no-show after deposit.. What are our options 4Nov 28, 2011 11:14 pm Rupz, Agree with Adam. Please post the fencer details for the world to know. Yours sounds like my fencer, he gave me an initial quote(after much following up) , I found a mistake and asked him to rectify (via email, since he never picks up the phone ) and finally after 20+ phone calls and emails, I got in touch with him today and he sent me the revised quote. Only reason going for him is his quotes are far more cheaper compared to the others I got the quote from. Re: Fencing guy no-show after deposit.. I'm not defending the fencer, but I think you may find the rules of this forum warn about naming and shaming individuals for fear of the poster being sued, however the consumer website Not Good Enough does and IF they regard the complaint serious enough may contact the fencer on the complainant's behalf Arfur Re: Fencing guy no-show after deposit.. What are our options 6Nov 29, 2011 12:58 am Correct me if I'm wrong, but I was of the understanding that as long as you are stating facts, with proof to back it up (ie: receipt of bank deposit) and not posting based purely on emotion, that you are able to mention the company name. Fencing guy no-show after deposit.. What are our options !? 7Nov 29, 2011 6:33 am Rupz, can u pls PM me the details of the fencer u r talking about? I am about to pay the deposit and can hold back before I make the payment if it's the same fencer. Thanks Re: Fencing guy no-show after deposit.. What are our options 8Nov 29, 2011 7:13 am That's horrible, I hope you havent lost your money Keep us updated Re: Fencing guy no-show after deposit.. What are our options 9Nov 29, 2011 10:41 am It's not defamation if you say: Fencer by the name of X (ph: was paid $X on the X of X 2011 of which the agreed date to commence building our fence on the X of X 2011. It's now been X weeks and I am unable to get in contact with him and was wondering if anyone could help? Nothing defaming and your not stating anything false. Oh an rajan, I would steer away from that guy at any cost! Re: Fencing guy no-show after deposit.. What are our options 10Nov 29, 2011 11:44 am Hi everyone, Please read the whole of this thread: viewtopic.php?f=13&t=29877 Yes, ask for 'What do I do next?', 'What are my options?', 'Who can I contact?', but I would be very hesitant to post the person's name or contact details in the public domain. Let's see if anything happens this Saturday, but I am not holding my hopes high. also, if anyone has had similar experience with a fencing guy ...can you please PM me ? Thanks so much everyone for your replies.... Re: Fencing guy no-show after deposit.. What are our options 14Dec 05, 2011 3:04 pm rupz, Ring the police. The dude has basically stolen your money at worst, or obtained it by deception at best. It has been long enough. Geoff - Decophile. Re: Fencing guy no-show after deposit.. I would be calling the police. Re: Fencing guy no-show after deposit.. What are our options 16Dec 05, 2011 8:39 pm Not sure if this is a really 'dumb' idea... but try calling him from a different phone no. - maybe get someone else to speak/leave a message so he doesn't recognise your voice. Pretend you are a new client - saw his ad - would like a quote or to get some work done - make it sound all innocent and above board and nothing suss. Give him a friend or family member address (maybe not in same suburb so as not to 'alarm him' and see if you can coax him around for a quote. He might think he has 'lured a new spider into his web'. (I assume he does come around to give a quote or was this all done remotely?? Sorry can't remember if your post said.). Then, when he gets there, maybe have a few mates with you, make him feel a bit threatened (not in a threatening sense, but just in the sense that he is not on his own turf or on his own terms) demand your money back - and/or have someone follow him to see where he lives/get an address to chase him up. Even if it doesn't work or nothing comes of it (ie, unlikely he will have cash on the spot to return, but ya never know - or you can 'volunteer' to drive him to the ATM). Tell him if he doesn't pay up you will be calling the cops there and then. I don't know... all just ideas???? At the very least, it will make him have to think twice about attending more properties for quotes or to undertake work because he'll have to think twice about who might be waiting for him. ?????? Just a thought. Good luck. HHCIB Oh, and PS... IF you do decide to do something along these lines, don't stop trying to contact him from your own number. For eg, if you have been calling this guy daily, even after you make 'the other call', keep calling daily from your own phone. You don't want him catching on that you have suddenly stopped calling since he got the other call and that the other 'interest' could be a set up - if you know what I mean. Make him think there is absolutely nothing connecting the two. Re: Fencing guy no-show after deposit.. Speaking of ACA and TT why not contact them and see if they know of him or will assist you? Arfur Re: Fencing guy no-show after deposit.. What are our options 18Dec 06, 2011 9:44 am UPDATE hi guys.. thank you once again for your ideas and replies So far we have tried everything: 1. We have tried calling him through a different number but he did not pick up our phone. But that was on the day he was supposed to be coming to do the job at our place - so he must have guessed it was us. 2. Ringing the police - yes this thought did cross our mind. But we were sort of avoiding since we thought this is a bit extreme and he might show up. But now it looks like we have to go down this path ... Just another question I was filling out the form in CTTT (Tribunal) and it is asking me for his address details which I don't have. There is only ABN number, His name and Phone number on the Written Quote which he had provided us. What can be done in this case... If the address is missing, would it still be ok with the tribunal. Note: The form on the tribunal does not allow to go to the next page if we keep the address blank. Re: Fencing guy no-show after deposit.. What are our options 19Dec 06, 2011 11:03 am i would ring the CTTT and explain to them, they may be able to help you fill it out. also, where did you see original add?? if it was in paper or net, give this info to them too, as they prob have the power to contact them and find out address of person who placed the add or their ISP address - which the advertisers would likely not give you due to privacy laws. dont know if it would work but just a thought.
