Browse Forums General Discussion 1 Nov 22, 2011 9:05 pm We're currently building a home and have a question about fencing costs so I hope someone can shed some light. Please take a look at the image below. Our block is 238 and I've highlighted the proposed fence in question. The small section highlighted in red is shared with our neighbour 236. The blue area is their garage. My question is whether it is reasonable or not for me to ask them for their share of the red section (which is about 3 metres) even thought it doesn't really benefit them in any way. We obviously need it to cover our back yard. I think that legally they would probably owe half the red section but I'm not sure if this is fair to them. What do you guys think? Your local Council should have all the relevant forms, notices and agreements to serve on them, and will probably advise you to do it by the book should problems arise later and leave you with no legal standing. Ive found nothing starts a 'blue' quicker between neighbors than mentioning a fence Arfur Re: Fence help: Question about share of fencing costs 3Nov 23, 2011 10:30 am Yup they should pay for half of the small bits of fence to both sides of their garage (at the back of your block) just as they will have to share the rest of the cost of that length of fence with the owners of block 237. Most fencing companies are used to dealing with that sort of things and will assist you with obtaining the neighbour's details and sending them a quote etc. Good luck Re: Fence help: Question about share of fencing costs 4Nov 23, 2011 1:53 pm A different thought: If it was me I would cut the fence back at an angle to the corner of the garage andd plant a shrub in the triange. Re: Fence help: Question about share of fencing costs 8Nov 24, 2011 4:24 am I had a similar overlap issue with mine (House directly behind me was shorter than mine, so I had 2m of a different neighbour in the corner). To be honest I just paid for it myself. I think it set me back an extra $120, but it was quicker and easier than getting in contact with the owner of the block, who my side neighbors had a lot of issues getting in touch with. Sorry but no, you have to bear the full cost on the street side, same as if you did a front fence, would you expect the council to shell out for half of that? Sorry, I miss-read the original question. I am aware that I would be bearing the full cost of the fence on the street side. I personally would just pay for it myself. It can get messy and wind up in the Local Magistrates Court. That's why Councils always advise getting EVERYTHING in writing. IF it ends up in Court and you lose, because you stubbornly said NO without good reason, then you can have the costs (about $200) awarded against you. We'll be moving soon and would like to have the fencing installed, for privacy reasons plus we can start doing the landscaping. We already asked our neighbors regarding our intention but it seems that they don't have any plans yet. By the way, they have moved in already few months ago. Different laws apply to different reasons for fencing.
