Browse Forums General Discussion 1 Nov 09, 2011 10:44 pm Hey All, Wondering if i can seek some advice from the people on here and get some help! 2 and a bit years ago the Old's signed up to have a builder build their first home, all was well they met with him and it was decided and i think for memory a 8month contract was signed anyways 2 years on and its almost finished, long story cut short builder was shi*, dragged his feet said weather was crap blamed it on materials ect come up with every excuse in the book. Anyway now for the advice part The builder says hes done, they go around and check the house find problems, laundry cubourds arnt installed (says he will do it waiting on materials) bad wall light joints, floorboards with scratches, doors not lined up properly, outside joints in the roof not flush look crappy, anyway they say there not giving him final payment till its rectified he says its all fine he wants payment. On way out the old boys pushing against the front wall and its got movement (its kinda of a steel frame with wooden slating cover hard to explain) builder says its suppose to be like that. Perents go to archetect on the side and get his opinion, wall is not structually sound in his opinion and needs to be recified, they go to a lawyer and get the lawyer to put some pressure on the As*ho*le and he says fine ill put a beam in to make it better perents disagree as its a huge beam hanging out of the front of their house which honestly would look so out of place. builder is saying he wants final payment, they dont want to make it the house is not up to scratch they have already spent 5k on a lawyer just letters back and fort and they arnt really keen on going to court for the extra expence (final payment is 35k) can anyone give any advice this bloke is a complete ***... is the media an option what can they do were do tey stand? Re: Bad Builder Advice Needed 2Nov 10, 2011 8:59 am They don't need a lawyer, its waste of money, Fair trading will make him fix all the defects and it wont cost you anything. First you need Building Report done by professional Building Consultant and he will decide what is wrong and what not, and whatever is in the report you are entitled to be rectified. The law says that you pay your last progress payment, and then you must report any defects within first 3 months, and then Builder has another 13 weeks to rectify any defects. If he doesn't follow that you go to Fair Trading fill up the complaint and Fair Trading will inspect all the defects and give him a list to rectify otherwise his licence could be canceled. This is HIA contract rules, if they used different building contract you will find all the info in the contract, about last progress and any defects, and you must follow that. Do not go to lawyers. Builders get a ruling stating to pay or fix up and they will continue to work under a different name and ignore the rulings.
