Basically, I just received a call from the the builder that handover will be delayed. The reason being the certifier cannot issue the occupancy certificate until the lots on my land has been consolidated. Wish they told me this sooner so I could have it done while the house was being constructed. I dont think anything needs to be surveyed. An internal boundary is being removed, so a surveyor should be able to redraw the existing plan without the it. Should only be a few hours work (say $400) then lodge that in your state Titles office. I am from Qld, I think thats how its done here. We weren't trying to avoid any subdivision fees, just replacing the house. Basically if you lodge an applicaton to build a new structure it's envelope cannot transgress a lot boundary. If you are doing a knockdown/rebuild, why didnt you just rebuild inside one lot? Re: Anyone know the process of Lot Consolidation 7May 21, 2014 1:01 pm Our land is weird because it's actually two narrow lots combined. About 7.5m wide for each lot. There is actually a third lot behind the front two (used to be a lane way) but it's far back enough so the house doesn't cross over the boundary. Never knew it was going to be a problem since the old house was already sitting on the boundary of the two lots. I would assume every house on the street is in the same situation, the plans show all narrow lots and every house has a 15m frontage. Just a pain to have it come up so late in the process. We're basically at handover. But the banks won't release the funds for final payment till we get an occupancy certificate, and the certifier just brought up the lot consolidation as a requirement. If they have told us earlier, we could have gone through the whole application while the house was being constructed. Now, it's going to delay handover for 3-5 weeks. The question is, to whom was the building permit was issued to by council? That party is managing the permit conditons, and is remiss in not addressing this early on. It might even be you? If a 3rd party made and took the application, I would give them a serve. Check your contract with them, do you have grounds for compensation? Request compensation anyway. We applied for the demolition DA but our builder applied for the construction DA. Not too sure about compensation since there's a clause saying occupancy certificate is not required for handover. The hold up is the bank who won't release the funds without the certificate. Might just have to make the final payment ourselves and get the bank to reimburse us.
