Browse Forums General Discussion 1 Aug 23, 2011 11:40 am We have built in a new estate. The house next door to us has recently been finished and fenced (that was their package). Their builder knocked on our door and told us that our portion of the fence is $660 which is payable directly to the him, after he had already finished. My question is, is it normal for a builder to quote the whole cost of the fence in a home and fencing turf etc package and let the owners then ask their neighbours for money or does the builder normally only quote for half the cost and then have to run around trying to get money out of the other neighbours. There are still plenty of vacant lots here. In fact this is our only neighbour so far. It seems strange to think that the builder has only quoted half the fence and may never recover the rest of the money. In a nutshell we don't trust that he is not double dipping and making a tidy profit. We did have a discussion about him giving us a quote to finish all of our fence, which we never got. We had also talked about wanting the palings butted up instead of a breezeway. He took that as an agreement. In our minds it was just a conversation on what we wanted in our quote. We are happy to pay someone but want to make sure the money is going to the correct person. Our neighbours think they have left their contract at the tile shop and are trying to chase it up, but we are not sure that the fence will be on it anyway. At the least you should be asking to see the invoice for the fence, and make sure you're not paying a margin on it. I am still waiting to be invoiced for $350 worth of fence behind my house, about 1 year after it was built. Apparently whoever built it doesn't need the money. We got handed a bill for a fence that was the wrong address and it was $500 more each. My neighbor had paid already but I took one look and said this isn't even ours. I also went and told the neighbor because the fencing guy didn't. He had to wait 2 weeks until they paid him back by cheque after he paid in CASH! Ask the builder for a copy of the invoice showing you the cost of the fence, you can then pay half of that. A friend of the neighbours who builds fences said the palings are no good and the nails aren't long enough for the fence. 2 palings have already blown off in the wind last week. If he hasn't fulfilled the legal requirements re: issuing a notice to fence and there are no invoices then I suspect that the builder is high and dry regarding his fencing contribution claim no matter which state you are in. Sounds totally suss to me and I wouldn't be paying a red cent until it is proven otherwise. Some people apparently have nothing better to do than comment on other people's sigs. I don't want to get out of paying at all, I don't think the neighbours want to cause trouble with him so don't really care if we pay the money directly to him, but I don't feel right about handing over money to someone who it seems is a bit questionable. Well legally I don't think he has a leg to stand on given the lack of notice served on his part (you can't just put up a fence and come looking for a contribution from the neighbour in person afterwards without following the correct legal procedure) and claims for fencing contributions are always settled based on a reasonable quote for the minimum acceptable fence as set out in developer/council guidelines, so he's in trouble there as well. Then at least then we don't have to deal with him anymore. The only problem is he is now building 2 doors, so pretty uncomfortable.
