I moved into my propoerty last year and when it rained for the first, only then we realised that the storm water drain pipe was blocked and water was overflowing the LPOD (legal point of discharge) in the front yard. I then contacted the builder and they did some investigations and came to the conclusion that the block is under the nature strip. They brought some equipment out for this like camera, high pressure drain unblockers, etc. Since the blockage is under the nature strip this should be fixed by the council. I then contacted council, who did their own investigations and said that it should wither be fixed by the owner or the builder. They were adament since this is a new property it should be fixed by the builder as it may be clogged up with all the building materials. This has been going back and forth and I am kind of watching the pinog pong. During the last investigation by the builder they claimed that the pipe is not connected to the council mains at all as the high pressure equipment was just turing out dirt. Not sure what to do here, my front yard landscaping work is also held up because of this. Any advice/suggestion here will be highly appreciated. How difficult / deep would it be for you to do some investigations on your own (aka digging)? Or is it completely impossible due to some unknown (to the readers) reasons? LPOD is the pipe to which all the downpipes connect to, it is a pipe that is laid by the estate developer connecting the council barrel drain to the property. You have a contract presumably stating that your builder will provide stormwater drainage. They didn't provide it, therefore they did not complete the works specified in the contract. Let them know that you understand they are in a dispute with the council and/or estate developer, but that you need drainage NOW, and they can resolve their dispute in their own time. If the builder really believes it's not their problem then they can fix it themselves, document what they found and then pursue whichever party caused the problem to recover their costs. That's what I'd do if I still didn't have stormwater pipes connected after a year. Storm water drain pipe blocked 9Aug 16, 2011 7:05 am Hi I can't understand how the council can claim that this isn't their problem (well, they are a council so I can understand how they can claim it, but I still think it is their problem). As I understand it your pipes are delivering the water to the LPOD, so there is no blockage on your pipes. The definition of LPOD says it all. It is the point where you may legally discharge your storm water. If the blockage occurs after the LPOD then it is in the council service - I think of it like the water meter or electricity meter - it is a service boundary. Anything on one side is my problem, anything on the other side is the service provider's problem. Developers are required to provide this sort of infrastructure when they create an estate, but this infrastructure passes to the council once the developer has finished. You say you have tried water jetting (which makes sense - why fight with council when you can solve the problem relatively cheaply yourself) and it appears the pipe isn't connected properly - this is something the council should take up with the developer or just rectify themselves (council are supposed to inspect the infrastructure before accepting it) - either way it shouldn't be your issue.
