Browse Forums General Discussion 1 Jul 01, 2011 4:56 pm Hi All, Im building a new house and the neighbours on both sides have already been finished and living in their houses for around 4 months. I already had once fence up before my build started but the other one is not up. The builders put in a retianing wall in certain places but for the majority of the yard lenght around 18 meteres they tapered the soil down its a 600mm fall. We cannot put a fence in due to the fall and the fence possibly falling over and I must retian the rest of the side of the yard so that a fence can be erected. I cant find anything in my HIA contract stating that I cannot do anything to the land and there is a lot of water pooling around where this wall should be because the wall is not retined and draining not it place. I have already applied for a permit with the council to complete the wall and have engineering drawings of the current walls in place. I'm just going to continue the wall to the back fence so we can erect a fence. Anyone know what the builders can do if I head out there this weekend with my uncle who has an excavator and complete the cut and drill the holes out and install the rest of the retaining wall? We wont be near the house build? Its the side of the yeard and a lot of the backyard? However if you have an accident and try to claim against the builder (say you fell in a trench) or damaged the house you may find the builder may want to action against you. Re: Wanting to complete retianing wall before Handover? 5Jul 03, 2011 2:25 am As everyone else has said, you legally are not allowed on your land as soon as you sign a contract with a builder as you sign over all access rights to them. It's best to check with your builder regarding access during construction as some are more lenient than others. And as bashworth said, be aware that if there is any damage over the weekend or anything that they can even remotely pin on you (ie if they can blame your digging, compacting etc), they will say that you are to blame and they will not cover fixing the damage.
