Browse Forums General Discussion 1 Jun 04, 2011 7:38 pm Greetings o wise ones, Hope some one can help me out with this. Am currently drawing up some rough floor plans for studios/granny flat accommodation but will have to get a drafter or designer to polish up for council submission. Question is.... if I want to duplicate the buildings over and over by using the plans, is my designer likely to want to 'own' the plans or do I have the rights to do what ever I like with it? Cheers, Pete Re: house plans 2Jun 04, 2011 9:11 pm Hi Pete, I have just asked a designer I know (ie. the o wise one on this topic ) to confirm this, and it is as I thought... If a designer/drafty/architect draws up plans, they own the copyright. An owner can never own/buy that copyright, but instead can seek the permission to use the design, multiple times if required. Some design companies/individuals will charge for that permission, others won't. If the designer/drafty/architect you use is paid a salary by a company, that company will hold the copyright. If they are instead a contractor or designing for you outside of their company, they will own the copyright themselves. This means that the designer is always allowed to use your house plans for any other client he likes. Also some people believe that if the design is changed by a certain percentage, it can be used by another builder without breaching the original copyright. This is a fallacy, it's not correct. If a design can be proven to have any aspect copied from another design, it is in breach of copyright. Think of it like a book - if you re-write a book and change only one chapter, you would be in breach of copyright. Hope that helps Really tight at the top of the stairs- how to get furniture into those rooms? Study books - does anyone really use them these days? Large storage closet would be more functional. 2 6882 6 11470 Ask the council if there is a chance of getting build over easement exemption. Sometimes easements are unused and 24cm is not all that much. Good luck. And yes any builder… 2 13723 |
