He would tell us he wants to discuss everything on the phone because he doesn't like email, which is annoying because he will promise something verbally, say he doesn't need to email the information to us (on our asking him to do so), then deny the promise later. Grrr!
He has no physical mailing address, no land line phone number, only an email address and a mobile number. This has made cancelling our contract with him (nothing formally signed yet, just the initial $1500 deposit given. No drawings shown as yet) difficult because we had to scan and email to him our signed letter of cancellation and deposit refund request. We sent it last Wednesday but thus far no response. Dh wants to go to the small claims court, but will try and call this chap first, to see what he has to say. Our new builder says that if we put into writing a request for the deposit to be refunded, then the first chap should have no reason to NOT give us our money back, but we're not even getting a response! Unless he is out of the country on holidays, he needs to be forgotten about. Move on, good choice! At least you know you have sent him a cancellation, what he’s doing with it is his problem. As far as court goes, entirely up to you, sometimes the headache is not worth it. Especially if it costs you more in court fees. $1500 is more than likely $3,000 grand to you (pre tax) so think of it as much more than 1.5k. Chase the bugger and make sure he does not get away with his antics.
