My local council is awaiting this report so that they can issue the construction certificate. However this is the issue. My neighbour is refusing access to their property to perform the dilapidation report they requested. Obviously it's a tactic they are using to stop the renovation. My council has been very unhelpful. All they have said is to get that report completed which is futile. The neighbours won't respond to who I have paid to provide the report nor do they acknowledge me or answer the door. What legal options do I have at my disposal? One of our neighbours didn't want to give access, so the builder (or person doing the report) put it in writing that if they did not give acces within a 2 week period, that it would be noted that they were given the opportunity within that time, but chose not to give access, therefore waive their right during the build to claim that damage had been done to their property due to us building. Our council (in Sydney) were fine with that (ours to was a condition of getting the construction cert, or DA approval). Bel Still not in.
