Browse Forums General Discussion 1 Apr 19, 2011 9:27 pm After we got council approval we used to drive past out block to see if the standard fence and portaloo were put on our land, ready for construction to start. The slab is about to be poured (piers were poured last week) and still no fence. Is this normal? Secondly, if someone is injured on our land, as in a random person walking on our block, are we liable or is the builder? Technically they would be trespassing but with vacant blocks around us I assume people would walk through the site on occasion. I'm a bit surprised that there's no fence, particularly as the site is on a 3m sloping block with a 3-tiered slab. Now that the pipes are sticking out of the ground I'm also concerned about potential vandalism. while there isn't anyone living in our street yet, the suburb is already established in earlier releases and the local teenagers are known for causing havoc in their boredom. Most councils require temporary fencing to be constructed. When I built with DFH a couple of years ago, the temporary fencing was not put up until the slab was poured. I assumed this was so that they could get easier access to the block. And When your house is being constructed the site is the responsibility of the builder...YOU are not even meant to be on site. So anyone falling in a hole or tripping over the slab will be suing the pants off your builder not you personally. This means all the run-off on the site must not go on footpaths, roads, stormwater etc. Bales of hay and plastic etc on the low boundaries. Also most local gov'ts require a wheel wash so that all vehicles can be hosed off before they leave the site. Also toilet (and safety shower, but ready access hose will do).
