Browse Forums General Discussion 1 Apr 11, 2011 8:04 pm We are in a situation with a retaining wall and would like all of your advise as to whether you think our objection will be successful or not? We are close to completion of our build in a new estate (Campbelltown Council, NSW). The back of our land drops about 1.5m from the rear of the building to the rear boundary (about 12m). There is already a wooden sleeper retaining wall (2m high) on the back and it doesn't have enough height to accommodate the leveling of our yard (and our neighbors). Just recently the developer intends on putting about a dozen duplexes to the rear of the property and we placed an objection to the DA around increasing the height of the retaining wall as I believe that failure to increase the heights of all the retaining walls will result in inconsistent heights, ugly fencing, erosion and drainage problems. There is only one developer in the estate and they are the same ones that have built our house. In all your worldly opinions do you think that this objection will succeed or fail? As we really need to start planning for fencing and building our own retaining wall if required....... Interested in your thoughts!!! For an objection to carry weight generally, the negative environmental impact of the development must be identified. Saying that the development will have a negative impact is not enough (in my opinion) without evidence. Perhaps you should ask to see prelim engineering details of how stormwater will be managed. This may lead to a redesign of the wall? Otherwise, it sounds to me like you are up against it. These are just my thoughts though. Not legal advice or anything that should be relied on! I think you are right in that it may be difficult to justify our objection but thought that it may as well be worth a try. As submissions were due to close yesterday I would expect that it may be a little too late to ask for any more information on this - however i will keep you updated with what actually happens.
