Browse Forums General Discussion 1 Mar 28, 2011 5:37 pm I have been planning to install additional fences along the boundaries in the front garden to the council line to allow a front fence to be installed. We have approval from the developers in writing so there is no problem there. We are experiencing a lot of problems with just the general boundary fence with one neighbour.
I concerned that they might be able to stop us putting a side fence out the front too. I am not asking them for any money, i will be paying for it all. We told them a few months ago, and there was no problems and they understood but they seem to go back on their word so it could all of a sudden become a problem. And obviously, i need side fences to have a front fence! Can they stop it if it goes on the boundary? Or do we come in a bit on our land? If its on the boundary, it is still technically half theirs even tho i paid for it. If i come in a bit, does it become 100% mine? I am also going to check into it with the council and legal services too and the developer. Thank you for any help! Is that right? If this is the case then any fence along the boundary whether it 1inch or 12inches inside the boundary that acts as a boundary line is shared between the two adjoining neighbors. If you don't want them to pay then thats up to you but it will still be 50% the neighbors responsibility to maintain and replace should it require maintenance. If the fence extension is of the same type of construction, I don't see how there could be a problem though. In the estate, the fences in between the houses do not go past the front of the house/garage. They stop in line with the edge of the house. You have to obtain approval to continue it out to the council line (towards the road), which we have. I dont see it should be a problem as i am not asking them for any money, but they are complaining about the fence we have to have and the way it is to be installed (there is only one way, unless they want to pay hundreds of more $$). Even if i wanted them to help pay, they wouldn't. But we've been advised from the developers and other departments that they can not stop us putting it up, which is good news. Most people would be happy as it gives you that bit of extra privacy (for free!). It's funny, on one side (opposite the drive way side) I'd like to extend all the way to the front but on the other, I prefer it to not extended, or at the most, a half height fence because it would block visibility when I'm reversing out of the drive way. If its a full height solid fence then I can see why they would care how it looks as it impacts how their house can be seen (or not seen) from the street and their visibility of pedestrians/other cars as they're leaving their drive way. I'd be interested to see if there are any council rules on the subject. It just helps give that bit of privacy near the windows/driveway and separates the properties, because so many just seem to blend in with one another in these estates!
