Our builder's sub-contractors appear to have dumped some building debris onto our neighbour's property and taken little care in doing what is right by them. They're now jumping up and down insisting the builder comes out there and fixes up their problems and clean up the mess left by the sub-contractors. I see nothing in our contract stating what the builder's responsibilities are when it comes to cleaning up site debris, left both in our land and our neighbour's.
Is there any hope the builder will take responsibility for what their sub-contractors have done and actually send someone out there to fix the mess they've created? What are our rights as their clients when it comes to something like this and if the neighbours threaten damages and legal action, will that get the builder's attention and that maybe they should clean up their act? Also, in the event they do send someone out there to clean up before any further work is done on the property, are they within their rights to send us an invoice for the "extra" work done? Again, I see nothing in our contract regarding this, so if there's nothing there, can they even charge us for something not mentioned by them in their own contract? Or will they simply see this as another 'variation' to contract?
