Buidling on a new estate in NSW. "Soft" landscaping refers to grass, shrubs, plants, trees, mulch, etc "Hard" landscaping refers to driveway, letterboxes, fences The boundary fence is timber lapped and capped fence. cost of the boundary fence is around $5k In my signed Tender it clearly states the following two paragraphs. "Provide hard landscaping including the following; - coloured concrete driveway and front path - single pier at pedestrian entry with insert letterbox" - this is included in the price of the Tender "Provide Soft landscaping to minimum estate requirements. Fixed costs to be provided once Landscaping plans approved - PROVISONAL ALLOWANCE" - this is not included in the price of the Tender After the plans were approved i requested the fixed costs but they would not give them. It has only been until after all the landcaping was completed, and after several weeks of nagging and complaining that they have finally (reluctantly) provided me with the original landscaping invoice. The issue is that now they are saying, although the boundary fence is usually considered "Hard" landscaping, it must be paid for separately, and therfore in this instance will be classified as "soft" landscaping and so will not be covered by the tender and will need to be paid for separately. This was not clarified to me at any stage throughout the building process. I know that the paragraph above regarding "Hard" landscaping does not specifically mention fencing is included or not. But it doesnt say that "hard" landscaping will only be those items listed. So i assumed that ALL "hard" landscaping would be covered by the tender price, and because they refused to give me any fixed costs before they completed the landscaping, i was unaware of what i had to pay. Im not sure what my rights are, but i believe as they did not clarify in the tender that Fencing will not be classed as "hard" landscaping, and the fact that they refused to give me an invoice, that I should not have to pay for this. What do you all think. Thank you kindly in advanced. I've dug some footings to embed a post anchor into. My holes are around 450mm deep which I'll put a 200mm stirrup into.
