Browse Forums General Discussion 1 Feb 11, 2011 1:54 pm Hi My name is Andy, we just purchased (actually paid the deposit) for a lot at Clarendon Drive in Lenley Section. Wife and I + 2 kids intend to move to Somerfield sometimes next year. ANYWAY HERE MY DILEMA: The previous purchaser has settled this block in December 2009 which meant that the Plans should have been approved by Somerfield Estate by no later than December 2010 and Construction should have commenced by May 2011. HOWEVER NONE OF THIS HAS HAPPENED. We are now wondering wether we can get an extension of time and for how long can it be extended, ideally 12 months. We have spoken to both the Developers Solicitors and the Estate People and no one can tell us wether they would approve the extension of time for certain. HAS ANYONE HAD SIMMILAR ISSUES, ARE THERE FINES FOR LATE CONSTRUCTION START??? I heard that if you dont start on time, the Developer reserves the right to purchase the Block back at the originall sale price.... ANYONES RESPONSE WOULD BE GREATLY APPRECIATED. I would also have my solicitor write a formal letter to the developer's solicitor and the estate people informing them of the delays experienced and as a result you seek an extension for late construction and that any penalties be waived during the extension period. Once they have a formal letter from yourself, you should receive a formal response in writing either agreeing to the new arrangements or otherwise. Having this formally documented is key.
