We have officially been told in writing that official site start was yesterday also, although nothing except a bin and a loo has been done on our land. (so no heavy machinary) Next doors lot however has been scraped and plumbed and excavated and back filled ready for slab. I noticed yesterday that they had a HUGE orange excavator parked on our lot all day (i assume it was for the digging of the lot next door). what i didnt notice until tonight when i went back was that they have accessed their lot with the excavator via our driveway and have chipped and broken all the concrette at the lip where ashfalt meets the concrette guttering, and have scraped on the gutter edge. (looks like they offloaded it in the middle of the road, then just drove it up the gutter) Seing as our builder has not stepped foot on our land with machinary as of yet, who is liable for this damage at this point? the land is in mernda villages and is still under the control of stockland. I have photos of the damage, and photos showing the progress of their lot, and the no work done to our lot. I think the good things in this is that you have identified the problem before anything happened on your block so have informed people that it's not due to your build and have your arse covered for future in case! Re: damage to kerb, caused by next door builders, who's liab 6Feb 07, 2011 11:07 pm stockland said they have nothing to do with it, but to ring council and get details of who is building on the lot next door and take it up directly with them. i got details for the builder next door and have notified them that the sub contractors are the ones who did the damage, and they are to fix it. They said they will notify the contractor and site supervisor and sort it out. Went to lot today and all the areas damaged had been sprayed blue. my site has now been scraped, so i think it may have been my builders marking for photo taking purposes to cover their ***, as i didnt notify the other builders until very late in the afternoon, and knowing builders, there is no chance they would have acted at 4.30 and organised that!
