Hi All,
I was just wondering if anyone might know if a change of owners in a company means that the work done by the previous owner does not need to be guaranteed/warrantied anymore?
This is what I'm getting from the company.
Cheers

The reality is, it's nothing to do with who owns the company. If the company you dealt with before, is the same one (ACN & ABN) today, they carry the liability. The owner is irrelevant. If it's the same owner and a different company, they are not liable. Ed "ECOECO" At 'EcoEco', we design windows, we design the best windows, we do it for you, so that when you’re happy we are happy. The liability ****** with that entity. You can approach the new company and ask them if they will honour the old warranties - maybe they will... Thats what happened in the couple of companies I worked for when they where sold. They just sold off the trading name & customers. If the company that built your house has gone under, then that is where the 7 year compulsory home warranty insurance comes into it. http://www.insurancecouncil.com.au/Defa ... tabid=1292 Milesy, Re: Change of Owners - No responsibility for warranty? 12Feb 09, 2011 4:43 pm The owner said he'd pass my details on but wasn't willing to do the work unless I paid a fee. I asked if the previous owner was still in the fencing business and he said he didn't believe so. There goes my chance of getting anything out of it! What a waste of $$$. The side gate and fence was hired separate from the builder so don't think builders insurance applies. Milesy, True, if the old company is still going, you can make a claim. Was he a registered contractor of any sort? Do you have anything in writing? Even a receipt / invoice? If so, then its his responsibility. Either he sold the responsibilities when he sold the business (unlikely and doens't sound like it) or he has to fix it / pay for it to be fixed. If you have something in writing give small claims a buzz and see what they say. Sometimes just the threat of legal action will kick someone into gear. Its often cheaper for them to just fix it rather than fight it. At the same time, is it cheaper for you to just fix it, rather then buggerising around? I know it might not be your responsibility, but $50 and an hour of digging and its done, well i know what I would do.
