I have a situation in Perth, WA where we have signed a contract with a builder for an agreed price. The deposit has been paid and we thought we were in the shire approval stage. The Operations Manager has just informed me that the consultant that came and measured us up under quoted the job by $9,000. He has told us that for $6,000 they will proceed or they will give us our deposit back. As yet they haven't started building. We planned and signed the contract based on a budget we allocated. Has anyone had this kind of thing before. I would have thought they should be bound in some way to the signed contract. We can get our deposit back but what about the bank fees on the loan increase etc that we've already paid? Some generic advice would be greatly appreciated if anyone has been in this situation before. Regards, If both you and the builder have signed the contract (and you have a copy) then I would think that the contract is in effect.
