They did not apply for a permit (however this was a part of our contract). We were advised of this by a building surveyor in June this year. I forwarded the contract and engineering etc. to the surveyor and after speaking to us on the phone he advised, not to worry, we have to advise you as the owner but we will be dealing directly with the construction company. Today in the post I received a building order to remove the retaining wall. The letter advised us that he had not received sufficient representation by the owner within the prescribed time limit. I tried contacting the said surveyor but he advised me to speak to him between 9 and 5 Monday to Friday and then hung up on me. Where do I stand with this? The retaining wall is a double brick concrete/steel core and if it is removed the house next door is likely to fall down.
